The ACLU indicates its objection centers on a provision in the recall process requiring at least 100 registered voters in each of 25 Illinois counties sign a petition to initiate the recall effort. According to the ACLU, that means voters in less populous areas of the state have greater value than those in more populous counties.
According to the ACLU, the disproportionate power given residents in less populous counties undermines the "one person, one vote" principle the U.S. Supreme Court requires as part of the electoral process.
ACLU legal director Harvey Grossman says passage of the question will lead to protracted litigation. He suggests the General Assembly revisit the issue and formulate a new recall measure.
